At least the select few I've dealt with personally.. check this.

So today I was driving into my town down a rural road, got behind a van. There's a big dip that goes down then up, and by the bottom of the hill I had gotten close behind them. They slowed to 25, but I didn't want to pass going uphill, so I followed them to a stopsign, where from there they got ahead. About 3 block later it was into town now, they were cruisin along, I caught up again and followed, then they kept slowing down, and finally hit the brakes HARD 2 times (I'm assuming they were trying to brake check me), and after that the lady stopped in the MIDDLE OF THE ROAD (it's a main road into town) and got out of her van. She yelled something similar to this, I know hte expitives are right at least: "You f***ing little pr***! Back the f*** off! Stop smiling (I had a WTF look on my face)! You're lucky you're young otherwise I'd beat your a**!!"
Then she turned on her hazards and called the cops.

So we sat there.. in the middle of the road for liek 15 minutes. At one point an onlooker went to her husband and suggested for him them to move the procession onto the shoulder. I asked him as he walked past my car and he said they didn't listen.

Finally a cop shows up, a sheriff lady, she asks me why we're sitting in the middle of the road and I explain pretty much what I just typed out. She goes to them, comes back and is like (and i quote) : "It takes two to tango you know?" I go.. "I'm sorry?" She replies "Two to tango.. it takes two to have road rage. She had babies in the car! You shouldn't have been following so closely!! You could've just passed them earlier!!"
I explained that I didn't feel I was following that close, especially since I was able to stop when she tried brake checking me. She took this as me saying "oh yea I ride people's asses allll the time".

So she goes, then gives me a $186 and 3 points on my license ticket! WHAT THE EF?!?!?!

I was blown away, she didn't even SEE this and cited me. I wasn't even tailgating like the lady said, SHE'S the one swearing at me in the middle of a road.

So I ask the cop is she found it inappropriate that the lady stopped in the middle of the road and swore at me. All she said was "she thought you were a big enough threat that she didn't want to continue having you follow her" then told me to take it up in court and gave me a written report sheet for me to fill out for testimony.

Seriously.. are police out to get us? I see a lot of picking on people and not much "protecting and serving".

And this lady.. seriously.. if she had babies in the car why did she try to brake check me and then stop in traffic??

Some people need to friggen open their eyes.

Needless to say me and the girl that was riding with me are gonna go hit up that court date for sure.. how could this POSSIBLY be beyond a reasonable doubt that I'm guilty??!

What total BS i wasnt there to witness it so i cant say you were doing wrong its your word against her the cop shouldnt have been able to give you a ticket because she wasnt there but what do i know im just a "kid". Sorry to hear about your little problem with the law let us know what happens after court!

Wow that sounds about homo right there.

i can't say much cause i don't like people riding any kind of close to me as i have alot of work invested. And when i go out to see this girl shes pregnant so i always take it easy and such.

Who knows maybe the babies are getting to her. I would say take it up in court and see what happens.

x2. But when I don't want someone behind me I pull over and let them go around me.

Clutch, tell them you can't make that court date and reschedule it for another day. Then go on that day. What I've found is that the cops schedule all there court dates for one day and then just plan on sitting in court that day. If you reschedule it you have a greater chance that they'll be busy and not show up. Even though I don't think you would have a hard time fighting the ticket and winning (I'm not a cop or any law enforcement, just IMO), it's easier to just have it thrown out.

My question is, why did you stick around? If someone stopped in the road and started yelling at me I would have gone around them or turned around.

wow... thats just screwed up... def fight that..

that is a good question tho... y did you stay? if someone stops and gets out of the car i would leave, just for the simple fear you have no idea what the person is gonna do.

i'd wait for bluestangs input.. hes more towards the law side of it

but to me it sounds like bs.. keep in mind thats only based on what your side of the story is, as we werent there.

fight it. write down your memory of it now before you tend to forget the details later on

You were cited because it sounds as if the cop was possibly having a bad day and just didnt want to deal with the situation at hand. Not sure the exact circumstances as there is always 3 sides to a story regardless of who tells it. Your side, her side and the truth. Most people tell the truth when making a statement just omit facts that hurt them or clean up the bad parts to sway the truth to their side...even cops icon_wink.gif

As for the ticket, fight it. I wouldn't worry about re-scheduling as the officer is probably not going to show up for this anyway. It's a waste of her time as she did not witness the incident and therefore everything she received at the scene is secondary evidence. She can only report what you told her and what the female driver of the van told her.

I wouldn't think you would get cited for following too close unless there were several people that reported the incident to police/officials besides the driver of the van. For her to stop in the middle of the road could have ended her up with a citation as well for blocking a public roadway or stopping without cause (although you didnt hit her so it would again be your word against hers; without witnesses this is semi hard to prove)

Things you need to do:
Request a copy of the officer's report from the scene to know before hand what she wrote (that way you know what entails in your traffic hearing instead of waiting to get it on the court date)
Challenge the ticket as the only reason you were following closely was to attempt a pass but did not feel safe enough to do so without endangering other traffic and motorists. You did not continue to stay close to the vehicle and backed off after realizing that a pass attempt could harm other motorists.

I wouldnt consider this a road rage incident unless you were flippin the lady off, cutting back and forth behind her vehicle and riding her ass like Big Brown's jockey at the Kentucky Derby.....could you have been cited for following too closely, Yes; but the officer would have had to witness it to have a viable reason to stop you.

Thanks for the advice Blue, it'll def come in handy I'd say. I'll make sure to get a copy of her reort when I go in to turn in my written statement tomorrow or so.

Also.. why'd I stay? Good question. I just didn't figure it was the best idea to leave. Seriously, she probably would've followed me or some crazy stuff and my luck it would've been considered leaving the scene. The scene of what I'm not really sure, but she would've tried to figure some BS out.

its good you didnt leave....then it would have looked like road rage as she would have said you harrassed her and once she dialed 911 and you found out, you left the scene....makes you look guilty.

She would just have to have given your plate to them and they would have pulled the registered owner and talked with you at your residence...trust me, Ive done it before just never had to go to someone s house.

Why in the hell would you stick around if she just stopped in the middle of the road, you didn't hit her or anything. I don't feel a bit sorry for you. She's the one who was yelling at you, turn her in for harassment

wow that sucks. i got pulled over for the first time ever the other day by a unmarked police car. AANNND i didnt get a ticket, he just came to my window yelling at me to knock that **** off and turn down the effin music,The reason he told me to knock it off, from where i was pulling out on the road is on a hill and very slick and hard to get back on the main road, so i spun the tires a lil and they squealed. didnt ask for liscence or anything, but had a cop car like thing, with the red and blue strobes and what not. MAybe just a grumpy man in a weird cop suit?

That's kind of wierd he didn't ask for your license. I think every cop will ask for your license to see if you have one even if he doesn't go back to run it through.

Maybe he was a wierdo with red and blue strobes that like to pull people over and scream at them and/or pull over women to rape them.

Did he have a siren?

Wow that is crazy, you should be able to win that in court, if the police did not see it happen then they are not allowed to write you a ticket for it! because there's not proof. She should be getting in trouble for brake checking you when she had babies in the car. You should be able to fight that in court and win it. Wow some cops... amaze me. It's people like that who give law enforcement a bad name.

Cops are always gonna be hated or adored. But they do profile my car. Been pulled over FAR many times in the past month then i ever was in the other focus.

Ever heard of a citizens arrest? As long as the woman was willing to sign an affidavit stating she witnessed you following too close and believed it was road rage...she wrote you the ticket, just went through a police officer to make it legit....you will be in court but her account of what happened will be presented with the case...

Just because a cop didnt see you do something, doesn't mean you dont get in trouble....think about murders, robberies etc...as long as evidence leads to you, in this case it would be an eyewitness account, you still get in trouble.

Ok, what I meant was, cops shouldn't assume that something happening and write a ticket for it. The cop gets there and assumes that clutch was tail gating and writes him a ticket for that when she didn't seem him tail gating! Although the woman was probably telling the cop that clutch was tailgating, there's still no solid proof that he was. I just believe that's wrong that he got a ticket. That's what I was trying to say.
