Advice : Needed

Ok so this is a hypotehical situation not a real life situation.

Names are fictious as well as the situation.



Marko comes home from work walks in notices that a lot of things are missing.

Markos Hears from a friend that Randy took them.

Marko procedes to drive to Randy's Apartment and confront him. Upon Randy opening the door Marko sees his one of his items in Randy's hand and the other items spread across the floor.

Marco asks for his items back and calls the individual out as a theif. Randy hits Marco in the chest, then Marco defends himself splitting the guy wide open.

Marco procedes to pick his items up and walks out as Randy is knocked out on the floor.




Discuss.

Sounds about right to me. I know I would beat the crap out of someone if I caught them red handed stealing anything of mine.

What exactly is "splitting the guy wide open" suppose to mean? Does that mean taking out a knife and cutting him? Or simply hitting him hard enough that it draws blood?

Marko simply returned the puch with a one two tap and ligths out Mike Tyson style KO. No weapons involved.

After being hit Marko defended himself.

how would randy own his own appartment at the age of 17, and if he did how would he be able to support himself enough to own a car and an appartment. come on banned, think a little harder then that.

guessing both of legal age. but seeing how there was a drug problem and fist fight and marko asked nicely for his stuff back, i think police could be called. I would call the police on a friend if they had a problem, especially if it led to them stealing my posessions.

Knate you're assuming the apartment is in Randy's name. It's possible he lives there with his great grandma-ma, and all she does is sit in a recliner and fart all day.

Both are adults. Marko is the working class and Randy is the felon/constant drug user.

Sounds like both parties have little to no brains. Why didn't Marko leave the appartment, call the police, and wait outside until they arrive? Also, having someone (Randy) punch someone else (Marko) in the chest doesn't give them the right to knock the other out. Marko can respond with force but not excessive force. It's the same category as the idiots who say, "if someone broke into my car I would shoot them."

Ever meet anyone high on Heroin or PCP? An old friend of mine was a lovely person when she was not high but when she was high should would steal from anyone just to get money for her next score.. She sobered up and is doing ok, but to say that Drugs dont make people do stupid stuff is ridicules... And BTW I dont affiliate weed as beeing a drug. This is by no way a rant on you Kwonrae, But ive seen it first hand and if you ever have to watch someone sprial down like that, it will change your outlook.

Marko, only "tossed" two punches. Then Randy fell to the floor. Marko proceeded to pick the item(s) up and leave.

Would this be considered excessive? Thrown in the One-Two punch format.

Since Randy was at his own residence , opening the door to a friend ,even if he has the stolen merchandise in plain view. He can come up with 100 stories as to why he had it (we know he stole it ) but he can say he knew it was yours and "recovered" it from another person and was going to return it to you ... Did he "hit" Marko first Or was it more a "push" back away type of thing ??? It depends on local law as to what charges can be filed ... Also Since Marko used to box depending on level of expertise he could be in worse trouble

I assumed he was speaking of Marijuana since he's only 17. But your right, I've been to rehab and seen unDetoxed, and Detoxed people and they are night and day. I retract that statement your correct.

Marko was punched in the chest not pushed. Samll recovery then proceeded to pull up guard and One-Two.

Marko was an ameaturer, nothing large scale. Cruiserweight boxer 23-6-2...

Marko restrained himself and did have a friend present at the time of the altercation.

Oh and please don't make assumptions using this for a reference to this story.

Im all for Marko.
When i use to work in this restaurant there was store behind us where this girl worked. She did heroin.
She was a real nice girl always seemed totally normal.
Then one weekend she went and used heroin. Cops picked her up walking down the middle of a residential street screaming her head off. not wearing pants. or anything else below the waist.
drugs make people do crazy crap.
Pot seems to be the exception in most cases

Randy is caliming to the police that Marko assulted him unprovoked and that he burglarized his house and stole these said items.

Items were registered electronics and a firearm.

Firearm is a felony correct?

Is the firearm registered?

Can you recap a little. I'm having trouble keeping up with this and that. I feel like every post the situation changes and more is added or taken away.

To let a person as low as Randy to walk on you is not a choice for anybody with any amount of pride.

Marko shouldn't be in this situation, and now the person who stole from him is trying to undermine Marko with a lie

People, the holding yourself back and calling the cops while waiting outside the door or anything such as that, in a story as clear as this, isn't an option. Once somebody who you KNOW has stole from you because you have seen the person redhanded also lays hands on you don't give an easy choice. Nobody I know including me will let somebody steal from them, then hit them with enough control to wait outside the door of a person wronging you, to wait for another to "take over". Wtf!. The only people who believe this logic are those who are to ***** to do anything about it in this situation. Why should Marko have any reason to fear losing his life in a jail for taking control of a situation that directly involved him.

Marko is trying to figure out a stand point.

Currently there are no cahrges being brought against Marko but he is highly concerned.

The point in which Marko was thrown over the edge was when Randy hit him in the chest.

No, people who do that are the people with brains and know the laws. Know that assault can very quickly lead into a VERY dicey court with the potential for a terrible conviction that could **** up the rest of their life. If Marko gets convicted of a felony assault, he can kiss all his firearms goodbye. But I guess that's a good risk to take just to avoid being called a ***** from someone on the internet.
Think about it, if he was this ***** you say, he would have his items back and not be in this situation. So, he would be in the exact same place he is right now minus the potential of being **** in court.

If Marko has no marks on his chest from the assault, it's not going to be good for him. It doesn't matter if he just hit Randy twice, it's the force he hit him with. Being punched in the chest (but not hard enough to leave any marks) does not warrant being knocked out (no matter how few punches it takes). If there are marks on Marko's chest, he should take pictures as evidence.

What if you and I were in this scenario, I randy and you marko. Once i hit you, idc how hard, I feel that the fact that I stole from you and am now rubbing it in would be enough for you to hit me back

Im not saying i'm calling a person a wuss for letting the law take over a situation, Im saying (i thought i was clear) that pride isn't something easily lost

A.) We all agree that it would be difficult to control yourself in a situation where a dude who took all you stuff punched you , but ..
B.) We all know we'd have the potential of facing some serious legal consequences if we stomped a dude out for the above, so ...
C.) What is the point of this exercise ?

Since one item stolen was a firearm, That would help Marko , as he believes/knows Randy has at least one firearm... After punching him ,he might be reaching for a weapon If the witness notices the same movements/possible going after the weapon then Marko is more justified to use the force he did as he was fearful for his life

I think hes a Fudge Packer, So I'd say his lvl of Expertise with the box was pretty high.

If Marko did not report the items stolen, Marko might be in trouble.

Marko and Randy are somewhat friends.

Randy says Marko borrowed him these items, or was holding them for him.

Now Marko is the aggressor and Randy is the Victim.

Marko only knows randy by association. He does not even know his last name. Marko has known of the guy from previous run-ins with friends and vehicle robberies only. At that time it was only assumptions and speculation.

Marko knew of the Randy guy for maybe three months, never actually talked to him or knew him.

Marko didn't know randy but only of him. Marko went and picked a friend up that knew the Randy guy... neighbor...

Apparently they staked Marko's house out and knew Marko would drive his sports car to work at certain times. Then Randy set in motion to rip Marko off...
