Well - today was my 4th appearence in teh West Allis Court System - another hour of my life wasted.
I recieved 3 illegally colored lighting tickets from the city of West Allis, and I have been tyring to get them dropped since. I was pulled over NEAR a popular cruising strip on tehse 3 nights, on my way home from work. Since it was NEAR the strip, and since I am a teen, I am ASSUMED to be cruising. Well anyways, the first 3 times I went in, I said not guilty and bam they give me anothe rcourt date. All 3 times and all 3 dates are different. Whatever, straw 1. Today was the first of these 3, I was called into the City Attourneys office and she reviewed my ticket. She claimed that since this incident happend ON hwy 100, they couldnt offer me any deals. On HWY 100? Thats ****, since I dont take that route home from work. Uh duh? Si I sat there and argued, and she said that I could fight my case by scheduling another hearing and speak directly at the judge. I asked her why the **** she was wasting my time with all the damned court dates and I ***** adn moaned about the other 2 I had comming up. An officer came in to see what the rutkus was about, and for some reason he felt the need to restrain me. Well yah, this got no where and it took twice as long as I had expected. So 4 court dates and I still cant do **** about these **** tickets. They are only 70 bones a peice, so I would pay the **** things but at 3 points a pop, **** that. I hate West Allis PD, and even worse their court system. Where the **** can I get a lawyer? I am sick of all this ****... |

Did a little poking around today, and didn't find any good news :-(
347.07 Special restrictions on lamps and the use thereof. (1) Whenever a motor vehicle equipped with headlamps also is equipped with any adverse weather lamps, spotlamps or auxiliary lamps, or with any other lamp on the front thereof projecting a beam of intensity greater than 300 candlepower, not more than a total of 4 of any such lamps or combinations thereof on the front of the vehicle shall be lighted at any one time when such vehicle is upon a highway. (2) Except as otherwise expressly authorized or required by this chapter, no person shall operate any vehicle or equipment on a highway which has displayed thereon: (a) Any color of light other than white or amber visible from directly in front; or (b) Any color of light other than red on the rear; or (c) Any flashing light. And it does say it is a 3 point violation. Guess what else is a 3 point violation? Driving with intoxicating substances in the cab. Horse ****. 347.03 Sale of prohibited equipment unlawful. No person shall sell for highway use any device, appliance, accessory or replacement part the use of which on a motor vehicle is unlawful. So wait, can I take this in with me and say if the kits were illegal, then why were they sold to me without warning? Because svc.com says nothing about the lights being illegal - since they are sold for computer use? Eh? |

porK: Although I am unable to completely understand law book crap, I don't see anything that says you aren't allowed to have lights while not on the highway. And since you weren't ON the highway, how do these apply?

Is there any way you could plea-bargain the points? The fine isn't too bad (yeah, it sucks, but it's easily dealt with), but the points are bad.... I can't believe that neons are equivalent to a DUI! That seems a bit extreme!
If you can't get out of any of this, can you go to a defensive driving class to erase most of the points? In NY, if you go to a course, I think it erase 3 points off your license. I know this isn't the best solution, but it may be a fall-back plan if the judge won't budge. (Sorry about the humor earlier... ) |

If I get these points - I am **** for 5 years. I have been looking foward to getting my CDL for almost 4 years now. If I get these points, they will be on my record for the next 5 years of my life. That means my career will be shattered...

I dont copletely think blaiming SVC for not having warnings will work, since they are originally designed for computers and you had to modify it (remove/cut the connectors off) and im pretty sure once you modify there product they are not responsible. Idk this could be coming out of my ass and im tired.

How bright is 300 candlepower? (besides the obvious answer of "300 times as bright as a candle...) How bright are neons? If they are only 299 candlepower, then they should be legal, right? |

Argue you were in a parking lot turning onto a street and you hit them off right when you left the parking lot, (if the cop doesnt show) they may believe you and think the cop saw your lights but wasnt thinking about you turning from a parking lot, perhaps thought you were turning from a street. Second if you were on private property, that citation does not apply. That stupid restaurant has the car ontop of it with colored lights, isnt that the same as your car being in a parking lot or other private property. Also could argue that cops dont always pull people over (cough, me and you driving past what 15 cop cars with my lights on? opps) tell them that only because your car respembles a police car it gets more notice and cops streatch the truth, again go for the private property or stopped on side of road, turned off, then starting moving. Cops are **** asses here, julian just got another one on his Formula...... Well goodluck....
