ok...my dad is realli mad at me because i moved out of the house... long story icon_rolleyes.gif i pay for my car...the insurance the car payments and the gas. well now he's gonna try and sell my car...he said the guy at the dealership we bought it from will buy it from him. well my name and my dad's name are on the title so legally he cant sell it without my signiature too right? because he said he'd forge my signiature but im not even sure that he needs mine...im only 16; im a minor.

youre a minor
if his name is on the title the car actually belongs to him and he can sell it wether he physically has it or not. so id watch out for tow trucks if i was you.

I don't even think he needs to forge your signature since the car is legally in his name. I do a similar thing with my parents, I bought the car and pay the insurance, but the car stays in their name for insurance and tax purposes, but once I'm 18, the title transfers to me.

So even though it seems unfair, he can do it.

it shouldnt be fuly in your name as your are under 18 and cant leagally own and insure your own car. it must be a co ownership.

laws may be diff in texas. here in ct you cannot get your own insurance until your 18 therefore you cannot own the car only in your name until your 18..

yup...i asked the cop at school n he said my dad doesnt need my signature...but im not staying home with all this **** so it looks like my car is getting sold...im definately gonna cry when it happens i love my car... next ?... can i unwire my neon lights n put them in a different car? will they still work n everything or not cuz if they wont then i'll leave em for the next person that buys it icon_cry.gif icon_sad.gif

Is the car paid off? Do you guys have the title for it?

First, As others have said, under 18 = no liability for you. Until you are 18 and deemed a legal adult, the parents take full responsibility. Thus is why parents are stuck paying for their children's damages etc.. when their children make stupid decisions.

While your name can be the ONLY name on the policy (such as when you buy from another person and they sign it over to you), you are still legally a minor, and therefor since your parents are responsible for your actions, they are also responsible for your stuff. Your stuff is their stuff. Even at 17, they can take your car that's in your name only and sell it. They can also revoke your drivers license. They can actually call the DMV as a punishment and tell the DMV that they wish to revoke your license for a given amount of time. At that point, if you do get pulled over by a cop, you will be arrested for driving without a license.

As the parent, they can take the car and sell it and sign as parent/guardian of the minor, and they are 100% in charge of your funds.

Your options:

1. If you are 16 and moving out for whatever reason, you can choose to go and get imancipated. What this would do is deem you as a legal adult, capable of making all of your own decisions and owning your own property without having parents that can have any say in what you do. At that point, you May have the ability to keep your vehicle. It then depends on how it's written on the paperwork. There are two ways that 2 people can be signed on a vehicle/item that requires documentation to own. There is "First person AND Last person" and there is "First person OR Last person". If there is an "AND" between your name and your parents name and you are imancipated, they are required to get your signature to sell the vehicle. If there is an "OR" between the two names, then either you or your parents can sign by themselves to sell it.

If you do in fact own the car and are not making payments to anyone, so you have the title, the one thing you can possibly do to get out of it, is find a friend that is reliable and sign the car over to your friend. If it's signed over to your friend then your father can no longer sell it as you "Gave it" as a gift to a friend. They then register the vehicle under their name until you turn 18 and have him sign it back over, or until you get imancipated.

The downfall of doing the above is two fold. One, you have to be able to trust your friend 100% to give it back and rely on your friendship not breaking up and him deciding to keep your car. Two, while it's under his name for ownership, in order for you to be insured on it, you will have to have it insured as his vehicle and you as a secondary driver, which means either he, or you would have to pay for insurance for him on your car too, even if he's not driving it.

It's a lot of BS, but tis the sick and twisted legalities of owning a vehicle. And vehicles are EASY in comparison to homes.. you don't even want to go there =P You could write a book 10,000 pages thick on all of the details of owning, buying, and selling a home.

i see that you own a pretty new car, but if your making payments on it and you want to move out and he's gonna sell it then let it go. Let him sell it or let it go back to the bank(i'm sure he got the loan or co-signed) Just live with the fact that your gonna have to drive an older car. You can get you an ok car for a couple thousand. I would rather drive an older car then my own father hitting on me.

P.S. Why don't you call the cops?

i did call the cops the first time...the second time(the most recent one with the car ****) they reported it to social services...he's on file its reported n next time they do it they go to jail so thats taken care of trust me... ya im letting it go as long as i can get my neon's out then its fine oh well i'll just get a beater

just stop making payments. either your parents will be stuck with the payments or the bank will repo the car. no point paying for a car you wont have.

oh dont worri im not makin the payments...i already told my dad i wasnt n he was like then ur loosing money but he will be the one loosing money cuz he isnt gonna get anywhere near the amount of money for it that i owe...he said he's gonna take the money back for the payments before im 18 n my brother went off n told him he better now touch my money so i have nothing to worri bout there... icon_biggrin.gif

Actually, you can make your own bank account at 16. You can't have a checking account without an adult co-signer, but you can have a savings account.

He's right on that one.. it's a medium that you can get by with a bank account, only for the fact that the bank account can't be overdrawn, and you can't write checks on it etc... There is no way you can gain debt by having a bank account, so that's why the banks let you have one as a minor without a co-signer. Your parents can still tap into it if they want, but they can't do it if they don't know it exists =P

As I said, legally you don't own anything until you are deemed an adult. You are deemed an adult when you either hit the age of 18, or you take the imancipation test (pretty much like a GED, stupid simple questions that in all honesty don't judge your ability to act as an adult, but they make you a legal adult just the same...).

Or isn't bad... OR means you can "give" your car to a friend, signing over the pink slip to him, and your dad can't sell it =) Then you use it until you turn 18 when he signs the car back over to you.

the insurance would have to be in the name of whoever you signed the car over to. so they actually pay the bill but you give them the money. only thing is if you get caught driving you could be in deep **** if your name isnt on any insurance.

You'd have to have insurance in your friends name with you listed as an additional driver. It will cost you a little more, but if you want to save your car, that's how you do it. If you are going to move out, then get imancipated as you will need to be able to sign legal documents for lots of stuff where under 18 signature won't be accepted unless you are imancipated. Once you get imancipated, you can have the car signed back over to you.
